Spouse & Child Application: Leave To Remain

You should use this product if you are either applying for your first grant of leave to remain in the UK or an extension to your existing leave to remain status on the basis of your relationship with your partner and children. To be eligible to apply under this route you need to meet the following requirements;

  • Your partner and children must be in the UK as a British Citizen or with settlement (Indefinite Leave to Remain/Permanent Residency).
  • You must either be married to your partner or have lived together for at least 2 years.

If all of the requirements are met then you will receive 2 and half years leave to remain in the UK. After this visa expires, you will need to submit an application for an extension of leave to remain or if eligible you might be able to apply for settlement.

Most people now know that obtaining a UK spouse or civil partner visa is not a straight forward process. The application involves knowing and applying complicated UK Immigration Rules. These rules involve an assessment of your relationship, fiances, cohabitation plans and your intention to reside with your settled spouse or partner permanently.

Your spouse or civil partner will need to meet certain requirements for your application to be successful. In particular they will need to meet the financial requirement unless they are exempt. They will need to be earning an income of at least £18,600 and an additional £3,800 for the first child and then an additional £2,400 for each additional child in order to meet the Immigration Rules. However your spouse or civil partner may be able to rely on third party support if they can prove they have a credible guarantee of sustainable financial support from a family member or friend. If your spouse or civil partner is not currently employed you may still be able to meet the rules if either you or your partner have a confirmed job offer and can prove that there will be credible prospective earnings from the sustainable employment or self employment. Alternatively your spouse or civil partner can rely on cash savings or investments if they have a sustainable amount.

You can get a rough idea as to whether you can meet the required immigration rules by completing one of our application eligibility assessments. However, please note that if you pass the assessment it only means that you may meet most of the specified immigration requirements for that particular type of application. A pass mark only indicates that it is more likely than not that you will meet the legal requirements,  as such your application has a reasonable chance of being granted. Our document checklist is designed to help you identify the majority of the documents needed for your proposed application. However, there may be times when for whatever reason you cannot provide everything on the checklist. In those circumstances you should provide what you can and explain in your application cover letter why you cannot provide the other documents. Please note that some documents are required for the application to be deemed valid. Failure to provide those documents will invalidate your application.

You may find that you have other documents that you feel would help your application.  If that is the case then add the further document(s) but only after you have carefully considered the impact those documents could have on your proposed application.  You should not submit any document(s) that contradict any aspect of your current or previous applications.
