Tier 1 (Entrepreneur Application: Extend Leave To Remain

You should use this product if you are already residing in the UK with an entrepreneur visa and are wishing to extend this visa. You will need to have already invested into one or more businesses in the UK with either £50,000 cash or £200,000 in cash. This amount will depend on the level of funds your initial application was based on. You will be eligible to extend your visa if you registered as a director or as self-employed no more than 6 months after the date you were given permission to stay in the UK.

To apply for an extension, you will need to prove the following;

  • You have been self-employed, a member of a partnership or working as a director of a business 3 months before you apply.
  • You have created at least 2 full time jobs that have existed for at least 12 months.

If all of the requirements are met then you will receive up to 3 years leave to remain in the UK. After this visa expires, you will need to submit an application for an extension of leave to remain or you may be eligible to apply for settlement after this visa expires.

This is an application to join a spouse in the UK. That spouse must already be present and settled in the UK, either as a British citizen or with Indefinite Leave to Remain in the UK. Those who wish to apply for a spouse visa must be outside the UK. The applicant must be able to demonstrate that they are married to a person who is residing in the UK, either as a British citizen or as a person with ILR in the UK. The applicant must demonstrate that their relationship with their spouse is genuine and subsisting and that they intend to live together permanently in the UK.

To apply for a partner to join you in the UK, please be aware you must meet the financial requirements of £18,600 and must provide sufficient evidence of your subsisting relationship.

If your spouse or civil partner is not currently employed you may still be able to meet the rules if either you or your partner have a confirmed job offer and can prove that there will be credible prospective earnings from the sustainable employment or self-employment. Alternatively your spouse or civil partner can rely on cash savings if they have a sustainable amount.

[Extremely important tip: A separate application will need to be completed and a separate appointment booked for each applicant applying. For example, if you are applying for yourself and 2 children, you will need to complete 3 forms and book 3 appointments].

[Important tip: You need to describe your relationship. Mention where you met, when your relationship began and how you kept in contact. If you have visited one another and/or taken holidays together, mention this and provide dates. Also mention when and where you married. This section should be as detailed as possible]

[Extremely important tip: If you are bringing a child with you whose other parent is not your spouse/civil partner that you are joining in the UK, you will need to make sure that you provide evidence that you have sole responsibility for your child and that they are free to leave the UK with you.  Examples of evidence to include are listed below: 

  • Death certificate for your child’s other parent to show they are deceased
  • A written statement (translated into English if not written in English) from your child’s other parent, confirming that they give full permission for you to take the child out of their home country and to live in the UK permanently – to show they do not object to their child leaving the UK
  • Evidence that you have sole responsibility for that child and that their other parent plays no role in their life and upbringing, such as evidence from the child’s school, GP, dentist etc that you are the only parent responsible for the child, letters from friends and family in your home country confirming that you care for the child alone, Court Order to show other parent has no access to the child.
You can get a rough idea as to whether you can meet the required immigration rules by completing one of our application eligibility assessments. A pass mark only indicates that it is more likely than not that you will meet the legal requirements,  as such your application has a reasonable chance of being granted. We do not recommend editing text that does not require editing as you could be changing important legal content. We recommend that you should only change the underlined and red text. However, if you feel that other changes are required and you are confident that the required changes will not have a negative impact on the overall strength of your application, then make those changes.  In such circumstances we would recommend getting your completed application checked by one of our lawyers before you submit it.

Our document checklist is designed to help you identify the majority of the documents needed for your proposed application. However, there may be times when for whatever reason you cannot provide everything on the checklist. In those circumstances you should provide what you can and explain in your application cover letter why you cannot provide the other documents. Please note that some documents are required for the application to be deemed valid. Failure to provide those documents will invalidate your application.

You may find that you have other documents that you feel would help your application.  If that is the case then add the further document(s) but only after you have carefully considered the impact those documents could have on your proposed application.  You should not submit any document(s) that contradict any aspect of your current or previous applications.
